Zwackery Posted October 28, 2022 Share Posted October 28, 2022 Hey forum friends, I've written a book chapter on Lucasfilm Games/LucasArts and the editor would really like to use the photo of the group found on page 35 of The Atari Connection Spring 1984. I've attempted to contact the photographer, Michael Jang, via Instagram as this is the only way to contact him that I've been able to find (even his website points you to his Instagram). I'm not willing to give up quite yet, and the editor is serious about copyright issues, so before I throw in the towel and go with another image, if you have a suggestion about how I should proceed, please let me know. jhd Posted October 30, 2022 Share Posted October 30, 2022 (edited) I am unfamiliar with American copyright law, but the Canadian law has specific provisions dealing with unlocatable copyright owners: ORPHAN WORKS IN CANADA: UNLOCATABLE COPYRIGHT OWNERS https://www.copyrightlaws.com/orphan-works-in-canada-unlocatable-copyright-owners/ Unfortunately, it seems that there is no equivalent provision in the American legislation (though you may wish to consult an attorney with experience in this area). Even if you do manage to contract the original photographer, however, the chances are very good that it was produced as a "work for hire", and so he does not own the copyright. That very probably belongs either to some corporate successor to Atari (good luck tracing those rights) or even an external marketing/PR firm that produced the newsletter.
