Seems Rainbow Arts had a bad advocate....  

At least today Nintendo would have lost the judgement, because there are no patentings (yet a copyright on the Game Super Mario Brothers) and the game was built from Scratch with no adaption of any code from the original (?).

you don't need patents or copyrights. i don't know the english word, but in germany there's something called "geschmacksmuster" (perhaps best described as "look & feel of something") which can be protected by law. for example, you can be sued because you build a 3d model of a car even if the it is slightly modified to remove the typical trademark signs of the car company. it's a bit fuzzy: you never know how far away your 3d model has to be to be safe from being sued.

 

same with computer games and game characters/game look & feel. if it's similar, you can be sued.

Indeed I will only release atr-images on the www (or email/PM), however I'll not use ATARI-AGE webspace.

 

Between you and me (and all the people reading =-) i don't mind hosting a disk image at Oldschool Gaming - 'cos we'd be doing a review of something this exciting anyway... =-)

Keep up the good work.

 

If Nintendo was going to go after every PD version of Mario Brothers they would go bankrupt with all the litigation, it just would not make sense and on top of all that it would be really bad PR for the company. Going after a site that has Arcade or current game console roms are one thing, but a game someone made themselves out of the love of the original just doesn't make any sense.

Freeware is perhaps the wrong word. But when the creator of a software drops off his rights, to keep away any indictments, how would anyone call this? Greyware?

 

Well, there's no such thing as greyware or abandonware as the law goes. In this case the game was removed from sale because it was judged too close to Nintendo's intellectual property so, at least from what i understand, that means it's still copyrighted in itself because it contains original work (code, reworked graphics and whatever was original, music) but the infringement is because it was released.

 

i seem to remember that Paramount went after people who produced Star Trek games a while back despite the titles being shareware (i think some were freeware, but i'm not sure) simply for the use of their trademarks. i've half expected a knock on the virtual door about my own little infringement for years now but it seems that Lucas and co. are a little easier going about tribute code...

 

The "fact" with Hard'n Heavy is a bit weird. Because it had been on the Market, and I bought it in a Game-Sampler for the AMIGA in 1992.

 

i've not played either for an age now but i believe that the C64 version was closer than the Amiga to the game to the plumber's antics (there were even some early screens in Zzap! 64 with the Giana sprites in) so it might be that the Amiga version was reconsidered for a later release - i've never seen it personally, but i know the U.K. missed quite a few Amiga titles like that.

 

When you say it was in a "game sampler" do you mean a playable preview or the entire game on a compilation?

 

The Amiga and C64 versions of Hard´n´Heavy are absolutely identical (with slightly better gfx and sound for the Amiga version). So its indeed remarkable they released it later despite its banning...

maybe there is a simple explanation. i guess rainbow arts was happy with getting a few bucks out of hard'n'heavy and didn't tell the mag about the legal issue.

Just wanted to say that this is the most exciting piece of development I have seen on A8. I don't care how long it takes to complete -I'll wait-, but I definately want to play this when it's finished!!!!!

You are coding some cutting edge stuff. Definately pushing the limits of the hardware. I am in the process of Reading through some of your posts hoping to pick up even 1/10th of what you are doing. Particularly interested in the MCS and Sprite multiplexing threads. Thanks for being an inspiration. I would like to read anything you have written on Advanced coding techniques.

I don't have internet at home and I have no plans of taking it either, but I must say, I'm still alive. The game coding progress is still on 94%.

 

Well,  

you know, the ABBUC software contest is going to have another run 2005 (the deadline has been set for August 31, 2005). Maybe if you finish your game before that time, you wanna take part in the contest, Analmux ?!? greetings from ABBUC - Andreas.

 

Yes, I'd like to take part. Now it's (again) a busy time for me, and it will stay like that for coming months, but I think I can finish it before the deadline of 2005. Really I wish I had a little more spare time to do all the things I'd like to do.
