I did some deep research and found the smoking gun. Lead investor in Asari is former Executive Chairman of Alphabet and former BoD member of - you guessed it - Apple, two companies which have quite successfully applied this cheap trick before.

 

(I don't want to be an ass and need to tell you I'm just clowning around. This is just Atari requesting some time to consult if they need to oppose to the Asari trademark filing, probably due to the similarity of the names. It's a nothing burger, or very standard business for a professional brand, not really worth a post)

Similar name is pretty useless.

 

You can have the exact same name if you are in a different industry.

 

Examples-

 

Apple (consumer electronics)
Apple Records

 

Delta (airline)
Delta Faucet
Delta Dental


Domino Sugar
Domino’s (pizza)

 

Dove (beauty products)
Dove Chocolate

 

United (airline)
United Van Lines

 

 

So probably not just the names Asari / Atari.

 

They probably could call their company Atari AI and still win a name case.

This is probably where they caused an issue- "For: Downloadable computer programs and downloadable computer software"

 

It's one thing to have a backend software... but if they are selling it...

Umm...no

 

There was a case of the World Wildlife Foundation vs. World Wrestling Federation over the usage of the letters WWF.  World Wildlife Foundation was there first so they won and the wrestling company had to re-brand themselves as the WWE.

 

Only way Asari can win is by proving it's a word that had a different meaning then Atari ("Check" in Go), so let's do a web search...
