Atari does not make any more games, and most games no one even has the rights too. But when you go into Nintendo territory you are dealing with a whole different ball game. Nintendo can be extremely anal at times, and they are the one company I could see making it happen so that you get arrested. Maybe I am wrong, but I think making reproduction carts of the NES system is chancier, even if others are doing it.
