Question about NES ROMs

So I'm trying to find a ROM file for the NES game Wario's Woods. Every site I go to says that it's protected by the ESA and can't be available. Why? It's not like Nintendo is losing money for a video game that's 14 years old. You can't buy it new any more, so they *can't* be losing money over it. I want this game, why is it so hard to get a rom for it? It just makes me mad that some games have to be "protected" for no good reason.

Nintendo does sell some of the vintage titles through the virtual console on the Wii.
