If I won this auction, and they weren't, then I'd leave negative feedback. Of course, if I *bid* on this auction I'd ask beforehand, anyway. The interpretation of the degree of "almost" leaves the seller a lifeline, here. His "almost" is probably my "nowhere near". On that subject, somehow, the meaning of 'mint' changed in the past few years. It used to mean... well, 'mint'. Now it seems to mean "lots of faults but not as bad as some of the other crap I flog on eBay". Sell me something "mint" and it better bloody well *BE* mint. Not "near new" or "only used a few times".
