Atari filed suit yesterday against StateFarm for their blatant IP theft of Crystal Castles in their Gamerhood ad series.

TLDR-

 

State Farm admits they did what they are accused of.  Then try to explain why they think it doesn't matter.

 

"Jake from State Farm, interacting with a 1980s-era arcade console for the game Crystal Castles. While the console’s marquee and screen
were covered with a fictional game title and screen created for the Video, portions of the game’s
original cabinet (the “Wrap”)—with what appear to be several graphical elements from the arcade
game—are partially and briefly visible for a few seconds during the Video."

 

 

Followed by such brilliant thinking such as-

 

"inadvertent and fleeting use of a decades out-of-date arcade game cabinet"

 

 

To which I respond- it certainly wasn't inadvertent- or else they wouldn't have changed the name.  They new what they were doing- just thought they could.

 

Fleeting is also irrelevant.   They either used Atari's IP or they didn't...and they already admitted they did.

 

....and saying it is out of date is also rubbish...it's either current registered IP or it's not....and it is...so...try again Mr Lawyer.

 

I stopped reading after that....

This is something that kind of irks me. I can understand it when something is intentionally being misused, but I think we've become far too litigious. Even when I watch like... home improvement shows (especially the ones that are filmed in Canada on HGTV). They put black tape over the Ford or Toyota logo (or whatever it is) of the car that the show's host is driving while they're driving down the road to the subject house they're going to renovate. Or they'll put tape over a Diet Coke, or cover logos on shirts or tools. Why? What is the point of that? Is it because of lawsuits? Misrepresentation of a product?

 

I don't remember this ever being a problem in the 90s or even the 80s when I was a kid. It does kind of make me sad.

Some of that may be 'if the owners of these products want endorsement, they can buy ads.'

In the old days, you *never* saw a brand marque on television unless it was on a commercial.  They were always taped over or replaced with generic "cola" cans or "cereal" boxes.

 

I think this started to change in the 80s.

 

the exception to this *might* be cars.  I can't remember if the general lee or starsky and hutch's grand torino were marked or unmarked, but in those days (especially with lower resolution televisions) you couldn't really read the branding on the cars, even if the silhouettes were unmistakable.

It was even worse for my Dad since I was raised in the south. He would yell "quit mashin those damn buttons and go get the yardwork done!"
