Homebrew ROM's (Unreleased or Incomplete)?

I am legitimately angry, especially with William, because I think he reported me to FSS.

 

Let me explain...

 

I am not even a ROM person myself. I just thought that certain people were making a big deal out of nothing. I am a "life is too short" guy. So I couldn't understand why normal, rational, reasonable people would be so against the idea of a ROM. I don't get trademarks and copyrights and all that jazz... because in the end, we are ALL flesh and blood and bones... and I think life is too short to be so stringent about sharing one's ideas with others. One day, we'll ALL be gone... and then what? What will these kinds of things that we tried to protect so hard (in our earthly lives) mean? Absolutely nothing.

 

That being said, what happened here is very simple. I TRIED something... and it FAILED. So what? They did not grant permission. It was a failure. Like I said before, I have no regrets. In life, you have to try.

 

And I STILL believe strongly that everybody has a price. Offer FSS a million dollars (or more), and see if they don't bite. I still say they will. But because I don't have that kind of money, I am forced to talk in hypotheticals.

 

Maybe I made a mistake in posting their email here. But that's it... it was a MISTAKE. Did the fact that I posted the email have to be reported back to FSS? I don't think so, but FSS just informed me that they were made aware of this thread. And I think it was William.

 

As I said before, I had/have every right to email whoever I want, on my own behalf, as a private civilian. I don't think, by contacting them, that I did anything wrong.

 

Reporting me to them (both my posting of their email here, and my "everybody has a price" comment) is, IN MY OPINION, the equivalent of kindergarten tattle-tailing, where the whole point is just to get me in trouble.

 

I didn't appreciate that, especially since I personally don't even use ROMs, and I personally couldn't care less about a Boulder Dash ROM being released. I am done with this thread, and I am done with this topic.

 

I am sorry that my efforts in TRYING to accomplish something were so unappreciated here, and I am sorry that my FAILURE (and my actions along the way) is/are being treated like the end of the world.

First Star did a copyright takedown of Digger Dan DX for the 3DS for being too similar to Boulderdash. And yes, they are overprotective of their property.

I think emailing them is fine. And they were very nice enough to offer an explanation why they decline instead of just saying no.

Nothing in life get accomplished when people don't think outside of the box, its a world where people, government, countries, ext.. judge ,suppress, point fingers ext. When people do think outside the box.. change, inventions and progress were accomplished by people who were considered strange , insane and outside of the norm. Thinking outside of the box.

 

 

We should not punish but reward efforts even if they end up being wrong or failing...

Hm. That makes me change my opinion about First Star Software. Yes, the game in question has elements that are similar, but then again some people back in the days may have argued that Boulder Dash was a rip-off of Dig Dug and Mr Do, which itself was a rip-off of Dig Dug. There were plenty of other games with similar falling mechanisms, and Digger Dan doesn't have falling diamonds. I rather get Sokoban feelings about that one. Then again, perhaps you can patent game patterns at least in the US?

I'm just here for the free ROMs and nothing else, but while I'm adding my 2 cents, I think it's a little dramatic to get upset for posting a reply from a company about a request. I don't really see what the big deal is. But if you want to get all upset because of it I guess that's your choice. After all, no harm was done in asking for permission to release the ROM. Eric is right that life is too short. It's also too short to get mad over things that don't mean a hill of beans!

Any judge making a decision on something lkes this always points out that they are not considering gameplay because gameplay is not protected by copyright. They are considering the work as graphical and musical art for protection. So you are allowed to ripoff a game as long as it looks and sounds like a different game. I've noticed that over the years judges seem to provide more and more protection to videogames for their graphics and animation. Maybe Digdug would have a better chance at a claim in 2016 then in 1984. Any patent protection from 1984 would be over long ago. Also, with Digger Dan, Nintendo made the decision not a court, so we'll never know what the law would say.

Sometimes just the treat of having to defend is enough to stop people. Deep pockets win over poor pockets. With genres like "Platformer" and "First Person Shooter" and "Maze" fully established it is very muddy water. One could say for example that Sidney Hunter was a copy of a Smurf game. Or Jumpman was Donkey Kong...it is a question of who will act like an orange haired business man and sue everybody or who will worry more about creating. I deleted my diatribe.

 

The good news is there are a LOT, a boat load, of games coming out.
