Coleco strong-arming homebrew publishers and fan sites

OMG! Cardillo is still going on about me being the "Producer" for Opcode! WTF! I have not "produced" any games for Opcode in the slightest! Have I helped Eduardo and given him advice based on my gaming production background? Yes. But I am in no way a "producer" for any homebrew developer.

 

Cardillo really needs to stop this. I will not stand for his bullying....

What are they trying to do here? Erase history? Or just can't handle someone with a large internet following calling them out on their bad actions? Note that they want something in return for their "proof."

So they NEED Pat's word to potentially clear their name? In other words, they have zilch. If you have something that can clear your name, you'd shout it from the mountaintops and post it for the world to see! I also find it funny that they think they need somebody's word about something they're lying about, but didn't feel the need to get Nintendo's words/permission or Konami's words/permission or anybody else's words/permission for their promotional materials.

Robb is not the producer on any of my games. He has helped advise me based on his past experience, but he has in no way produced any titles that Opcode Games have worked on. That was never necessary, as there is very little use for a producer with games that are basically an one man effort.

Dear Coleco,

 

I don't need a producer for two reasons:

 

1) there is nothing to be coordinated in terms of game production, as what I do is an one man effort (me)

2) games and SGM manufacturing are financed with pre-orders, so I don't need external help for that

 

And if you indeed provided "positive exchanges" about me with Robb, I never received any, which is funny considering you keep saying he is my producer.

And btw, stop sending me SMS at this late hour please. How about the proper channels, good old email. Actually forget it, nothing else to discuss.

Finally had the time to watch Pat's video. Pat is 100% right throughout the video. He's especially right when he said that in light of Cardillo's recent actions, we seriously have to question him and his cronies and wonder if they knew all along what Kennedy was doing. The actions of Cardillo and others at Coleco Holdings lately shows that they have a serious lack of character and we have to question if they EVER had any.

Not all of us live in your little small world of trying to squeeze peanuts from video games. I have a real world job, with a substantial wage. In order to me to justify Opcode was a business, considering the many hours I spend on each project and my real world wage, I would have to sell thousands of copies of each game.

So all this mess because you again don't have a clue about the ColecoVision homebrew scene and why we do what we do. Also, I would like to remind you that I am one of the very few CV homebrew authors that actually publish their own games. I do that because I don't think anyone else can produce the games with the quality I want, which again goes to show that I am not on this for money, otherwise I would use more affordable alternatives, or I would be publishing other authors as well (which I never did, it has always been a very personal endeavor for me).

I know you have a very hard time understanding that, but this shit for me is about being passionate about the ColecoVision and retro games in general. I have been doing this for more than 15 years, not just because it is now "hot".

The "brand" they've damaged countless times since the Chameleon debacle. The brand they've just poured gasoline on and lit a match to. They'd be more successful by just sitting with their thumbs up their butts and doing nothing.

Normally I would suggest to just ignore this idiot (Chris Cardillo), but in this case, everytime this guy posts a message or tweet, he just digs a deeper hole for himself, Coleco Holding LLC and River West Brands. As I stated a couple years ago, it's an utter travesty that River West Brands was able to acquire the rights to the "Coleco" and "ColecoVision" name, etc.

 

Really, what have they done with it:

- Cheap handheld system with assortment of Game Gear games included.

- Reproduction of the Head to Head electronic games

- For the most part (almost completely, thank god for Bill L.), R.W.B./Coleco Holdings LLC and AtGames ignored the Coleco Community concerning the CV Flashback.

- Coleco Chameleon... do I have to say anymore

- get in bed with a PIECE OF SHIT by the name of Ed (juice....., whatever the "F" his name was on here)

- Wrongly attack the ColecoVision Fan Facebook page and try to play it off as an issue with pornographic games that are pictured on the page.

- etc.

- etc.

- etc.

 

Think it's time to call for a BOYCOTT of the ColecoExpo!

 

Chris, here is the hole that you have dug yourself, Coleco Holdings LLC and River West Brands into..... have fun trying to climb out!

I'm glad to see Pat's video has almost 16,000 views already (about 10,000 more views than ColecoToys has followers on Facebook, LOL). The truth about what a joke Cardillo and Coleco Holdings really are is spreading quickly.

Edit: I see the video has 40 thumbs down... had no idea RWB employed that many clowns.

This is the youtube comment you are referring to.

I think the purjory bit comes from all the dmca takedown notice guidelines that have this.

"The information in this notification is accurate, and under penalty of perjury, I am the owner [or I am authorized to act on behalf of the owner] of an exclusive right that is allegedly infringed." I dont know if being the copyright owner or authorised representative is a requirement but it seems like it might be.

 

My understanding is the takedown notice requested by RWB is not about the trademarks but about specific games that infringe someone else's copyright. There are lots of examples of games infringing copyrights. But unless RWB owns some of those copyrights [or is authorised by an owner], a statement claiming copyright ownership [or authorisation] in the dmca request would be purjory.

 

Edit:

Further someone making a bogus dmca takedown request could be liable for damages. Damages being compensation for the affected party's legal fees and time to straighten things out.

 

I've read that more than half the dmca takedown requests are made by competitors (in this case competing colecovision facebook pages). And more than a third are bogus.

 

Maybe RWB got permission from one of the games' legitimate copyright owners to act on their behalf. It's possible?

Agreed. This is so juvenile it's comical. First he calls Pat a liar, then states he needs Pat's word to convince himself that CVF and Opcode are not in cahoots.

Cardillo doesn't seem to be embarrassed at all by the Chameleon fiasco. He's still shilling his NY Toy Fair brochure for $19.00 on eBay and describing it as "...a must have for all retro video game collectors":
