I could see why it would be a sore spot for you because iirc you invested money into it correct? Sorry but that isn't any "haters" fault, but the loudmouth who said so much and backed it up with very little.

 

Despite what that loudmouth said, a lot of the people he told people were "haters" were fans wanting it to succeed, who just didn't swallow the hook line and sinker.

Without the Intellivision name attached it may as well be any system. The vast majority of games are cell phone or flash ports. Now if released it wont even have Earthworm Jim, Toe Jam & Earl, and I doubt Dolphin Quest will be on it. 

I was the other side and liked the idea of simple games at affordable prices. I was hoping that with people from the industry it would get made and if there were classics that would be a bonus.

 

Good news is I heard a lot of good care was put into the Intv Evercade release.

Likely none of us are Trademark lawyers.  But common sense tells me you want the ENTIRE product name of the product you are selling to be trademarked. 
 

Would Sony trademark “Sony” and “Playstation” separate and not also trademark “Sony Playstation”.

Basically the arguement is you are buying an expensive console to strictly play what many consider shovelware on other consoles.

 

I really don't careabout the looks. I just don't see why I need to pay $350 to play Sesame Street games that I can already play for free with Jr Beefy (for free) on his $28 tablet.

Please read the contents of my 2nd link.

That particular trademark for "Intellivision Amico" was headed for its 5th and final extension to show use or it would expire.

By abandoning it they are simply indicating they are not confident they can show show use in commerce for this mark by this November.

They did spend a lot on keeping this mark alive prior to this. Contrary to reports, it was years of filings all public at uspto.

 

They have the option I expressed of combining the 2 other live marks, unless someone cares to indicate/prove otherwise.

If a console HAS to have Sesame Street games and other similar EC type games, just give it a tiny bit of effort, like the Wii games. Dont just port over a free flash game.

To be more serious, you can ignore the filings and read the tea leaves to know there's serious problems. I'm not a trademark/copyright lawyer but I do work for a firm that does it. I can tell you from talking to our IP people that trademark filings are very specific and complex to get right and past the USPTO review. And trademark and IP lawyers are $$$$$$. They're easily 4x what I charge as a corporate lawyer and I am NOT cheap. If Amico can't refund their existing orders, they definitely can't afford the attorneys' fees to draft, review, finalize, and file a trademark use extension or proof of use. Even if they had in-house counsel (which I highly doubt, given they slashed employees), it's not something that is inexpensive and easy to do, but is also basic and required to maintain a brand. And even THEN, the likelihood of their in-house counsel, if such individual exists, being a specialist enough in trademark and IP to be able to negotiate and finalize a trademark past the board review phase is next to zero.

 

If they can't do that......

 

If they can't afford the fees to get very, very basic protections on their products (or maintain the ones that are in place), the doomsayers are more right than anyone thinks, if you ask me.

If you look at the Amico mark it is strictly for the design of the word Amico. It is actually weaker than a standard mark because that would allow them to use any design and it protects the word.

 

Notice that their Intv mark is standard meaning they have that and can use any design. So if someone else came out with Amico video games they could just couldn't use the bubble lettering. It's similar to how Amiga couldn't stop them. If they were smart they'd have two Mark's for Amico. One is a basic Latin lettering format and one with the bubble letters.

 

They chose to keep people from using their bubble letters.

Exactly. So since they did pay fees for years, the intent -was- to use this mark.

btw-After the abandonment of both "Intellivision Prism" and "Intellivision Amico" marks their TM attorney did file extensions for the figurative "Amico" mark and the "Intellivision Together Again" mark, so they are still paying fees.

Hmm. Perhaps that was all they could afford, so they had to strategically pick which ones to keep extending. If they are outside counsel, they're definitely going to demand payment and are unlikely to allow the bill to float (like with some clients).

 

Either way, not a good sign....

They only paid for the design mark. They would have been better to do the standard mark as that protects the word and allows them to design any logo. Like how Nike does both a standard and special mark. The special mark keeps me from doing this for my own business.20220621_012734.jpg.bea943344ea8f965e2c4ded743aeda60.jpg

So theoretically someone could contest making an Amico console. Since they only have a design mark they would be in worses standing than if they had a standard mark.

Again, I'm just talking intent here.

Everywhere constant combining of the registered Intellivision mark and the filed for and extended Amico mark

Whether they still intend to brand in this fashion is speculation.

It came from Todd Linticum who is the VP of Product and Commercialization at Intellivision.

I'm sure it was an early mock up. It has some misspellings as well as the spine is formatted wrong (they fixed it in the unboxing video).

 

It's more amateur stuff by using other IPs instead of your own. It isn't like they couldn't have thrown a space ship, adventurer, or bi plane on there. They shouldn't post stuff like that publicly. Don't forget the use of Star Fox story in Moon Patrol.

There was one for the longest time there. I would say the big difference at this point is one released and one has yet to release.

What are that obvious reasons? The fact that it is very unlikely to come out? Then why discuss it here at all? I thought the mods decided since it was clearly a very divisive topic it was moved to its own section then later shut down altogether due to it causing more trouble than it was worth. Not sure why bringing it back here is helpful. I would suggest it has even less to do with the classic Intellivision now than ever before.
